Creator, sustainer, and redeemer of Abraham, Hagar, Elizabeth, and all people, we pray today that all might know your saving grace. To each of us and all people you have given the gift of life without regard to class, creed, orientation, or geography, but we give you thanks that you chose Texas for us. In this small portion of all creation you have placed seas and deserts, hills and plains, springs and rushing rivers, forests and prairies. Help us to be good stewards of all these and so much more you have placed in our care. You have brought people from all over the world to this place and time. Help us to respect and cherish the gift that each person is and the value they bring. We look for the time when peace is not simply the absence of war, when responding to a crisis means addressing the cause as well as reacting to the immediate need. We work for that day when all your people live long and healthy lives and have the needed resources to achieve their full potential. CSHB 18, A bill to be entitled An Act relating to consideration of the mental health of public school students in training requirements for certain school employees, curriculum requirements, counseling programs, educational programs, state and regional programs and services, and health care services for students and to mental health first aid program training and reporting regarding local mental health authority and school district personnel.

Amendment No. 1

Representative Price offered the following amendment to CSHB 18:

Amend CSHB 18 (house committee report) as follows:
(1)  On page 5, line 27 through page 6, line 1, strike "Sections 21.054(d), (d-2), (e), (e-2), (f), and (g), Education Code, are amended" and substitute "Section 21.054, Education Code, is amended by amending Subsections (d), (d-2), (e), (e-2), (f), and (g) and adding Subsection (d-1)".
(2)  On page 7, between lines 9 and 10, insert the following:
(d-1)  The instruction required under Subsection (d) may include two or more listed topics together.
(3)  Strike page 11, line 23 through page 12, line 9 and substitute the following:
(d-1)  The training required by Subsection (d)(3):
(1)  [that] must:
(A)  be provided:
(i) [(A)]  on an annual basis, as part of a new employee orientation, to all new school district and open-enrollment charter school educators; and
(ii) [(B)]  to existing school district and open-enrollment charter school educators on a schedule adopted by the agency by rule; and [.]
(B) [(d-1)     The suicide prevention training required by Subsection (d)(3) must] use a best practice-based program recommended by the Health and Human Services Commission [Department of State Health Services] in coordination with the agency under Section 38.351; and
(2)  may include two or more listed topics together [161.325, Health and Safety Code].

Sec. 104A.0086.  CONSENT REQUIRED FOR SERVICES TO MINOR. A mental health evaluation, treatment, or service may not be provided under this chapter to a child younger than 17 years of age without first obtaining the informed, written consent of the child's parent or legal guardian.
Sec. 104A.0087.  PRIVACY OF INFORMATION. The institute shall ensure that research and evaluations are conducted and services are provided under this chapter in a manner that complies with state and federal privacy laws, including laws related to patient confidentiality.
Sec. 104A.0088.  CONFLICT WITH OTHER LAW. To the extent of any conflict between this chapter and other law, the other law controls.

(b-1)  Subject to Subsection (d-1) of this section, in each state fiscal year, the comptroller of public accounts shall deposit to the credit of the Texas mental and behavioral health research fund $100 million of the net revenue derived from the imposition of the state sales and use tax on the sale, storage, use, or other consumption in this state of taxable items under Chapter 151, Tax Code, or its successor, that exceeds the amount of $30.5 billion of that revenue coming into the treasury in that state fiscal year.
(d-1)  The legislature by adoption of a resolution approved by a record vote of two-thirds of the members of each house of the legislature may direct the comptroller of public accounts to reduce the amount of money deposited to the credit of the Texas mental and behavioral health research fund under Subsection (b-1) of this section. The comptroller may be directed to make that reduction only:
(1)  in the state fiscal year in which the resolution is adopted, or in either of the following two state fiscal years; and
(2)  by an amount or percentage that does not result in a reduction of more than 50 percent of the amount that would otherwise be deposited to the fund in the affected state fiscal year under Subsection (b-1) of this section.

REPRESENTATIVE STICKLAND: Can you please explain what your amendment does again?

REPRESENTATIVE CANALES: Let me tell you what the bill does so I can explain what the amendment does. What this bill does is it talks about truancy and making sure we have reporting from truancy statewide regarding the numbers so that we can get a handle on state truancy. What the amendment does is––homeschools are already exempted. People that homeschool their children are already exempted from these reporting requirements, and the people that have homeschools requested this amendment to clarify that homeschools are kept out of my bill.

Amendment No. 1 was adopted.

Amendment No. 1

Representative Bohac offered the following amendment to HB 1802:

Amend HB 1802 (house committee printing) by adding the following appropriately numbered SECTION to the bill and renumbering the subsequent SECTIONS of the bill accordingly:
SECTION ____.  (a) Section 41A.05, Tax Code, is amended by amending Subsection (a) and adding Subsections (c), (d), and (e) to read as follows:
(a)  Not later than the 10th day after the date an appraisal district receives from a property owner a completed request for binding arbitration under this chapter and an arbitration deposit as required by Section 41A.03, the appraisal district shall:
(1)  [certify the request;
[(2)]  submit the request and deposit to the comptroller; and
(2) [(3)]  request the comptroller to appoint a qualified arbitrator to conduct the arbitration.
(c)  The comptroller may not reject an application submitted to the comptroller under this section unless:
(1)  the comptroller delivers written notice to the applicant of the defect in the application that would be the cause of the rejection; and
(2)  the applicant fails to cure the defect on or before the 15th day after the date the comptroller delivers the notice.
(d)  An applicant may cure a defect in accordance with Subsection (c) at any time before the expiration of the period provided by that subsection, without regard to the deadline for filing the request for binding arbitration under Section 41A.03(a).
(e)  For purposes of this section, a reference to the applicant includes the applicant's representative if the applicant has retained a representative as provided by Section 41A.08 for purposes of representing the applicant in an arbitration proceeding under this chapter.
(b)  Section 41A.05, Tax Code, as amended by this section, applies only to a request for binding arbitration received by the comptroller of public accounts from an appraisal district on or after the effective date of this Act.

(4)  a person licensed under Chapter 201, Occupations Code; [or]
(5)  a school nurse; or
(6)  the student's parent or guardian or another person with legal authority to make medical decisions for the student.

SECTION ____.  Subchapter H, Chapter 411, Government Code, is amended by adding Section 411.19501 to read as follows:
Sec. 411.19501.  WAIVER OF FEES FOR SENIOR CITIZENS 65 YEARS OF AGE OR OLDER. Notwithstanding any other provision of this subchapter, if an applicant for the license is 65 years of age or older, the department shall waive any fee required for the issuance of an original, duplicate, modified, or renewed license under this subchapter.

Representative Hinojosa raises a point of order against further consideration of the Toth Amendment to HB 2137 under Rule 11, Section 2, of the House Rules on the grounds that the amendment is not germane.
In the opinion of the Chair, the subject of the bill is the waiver, for retired peace officers, of application fees to obtain a license to carry a handgun. The amendment would waive application fees to obtain a license to carry a handgun for all senior citizens 65 years of age or older. The amendment is not on the same subject as the bill because one individual proposition may not be amended by another individual proposition, even though the two belong to the same class. House Rules Manual, 86th Legis., at 189 (2019) (citing 51 Cong. Rec. 548 (1914)).
Accordingly, the point of order is well-taken and sustained.

The ruling precluded further consideration of Amendment No. 2.
