PARLIAMENTARY INQUIRY

REPRESENTATIVE GEREN: I just heard the senate messenger read the captions of the two senate measures passed by the senate today, and I think I heard that these measures contain provisions relating to resident homestead exemption. Is that subject matter germane to the governor's call?

SPEAKER PHELAN: The governor's call is expressly limited to cutting property taxes solely by reducing the school district maximum compressed tax rate. SB 1 and SJR 1 are not germane to the governor's call.

GEREN: What are the next steps in the house for SB 1 and SJR 1?

SPEAKER: Pursuant to the explanatory note on pages 177 and 178 of the House Rules Manual and the practice followed during the called sessions of the 87th Legislature, the house will strictly follow the provisions of the Constitution, under which the speaker reviews all bills filed with the chief clerk or coming from the senate to determine the subject matter has been submitted by the governor and admits to first reading only those measures that are covered. SB 1 and SJR 1, therefore, will not be referred to a house committee.

If the actor proves the issue in the affirmative by a preponderance of the evidence, the offense is a felony of the third degree with a minimum term of imprisonment of five years.

REASONS FOR VOTE

Representative Bryant submitted the following reason for vote to be printed in the journal:

I voted for HB 1, the school property tax compression bill, because procedurally it became the only option available in this special session to provide taxpayers with significant property tax relief. But it is not the best way to do it and I will vote for a better option at the first opportunity.
The bill compresses (forces down) local school property taxes and replaces the resulting loss in revenue with revenue from the state, which comes mostly from state sales taxes. But sales tax revenue can decrease with fluctuations in the economy, while the funding needed for public schools does not decrease; yet no mechanism is provided in HB 1 to maintain public school funding when sales tax revenue declines. When there was a decline in 2011, the legislature reduced public school funding by $5 billion. Since Texas is already 44th in the nation (NEA Research Rankings and Estimates Report, Table C-4, 2020-21 School Year) in the state contribution to public education we can't afford to let this happen again.
Additionally, obtaining relief only through property tax compression doesn't remove the inequity in present laws: property tax rates decrease more quickly in school districts with high property value growth than in districts with lower property value growth. Further, owners of the most expensive properties will receive the most dollars at the expense of helping average Texas homeowners afford to stay in their homes. And because of prior law, compression also provides the biggest percentage reductions to those who already pay the lowest tax rates.
Additionally, property tax compression provides no relief to the 38 percent of Texas householders who rent their homes or to those who rent their place of business, unless the landlord decides to reduce the rent, which is not likely.
The right way to reduce property taxes is to dramatically and permanently increase the state's contribution to public education and to simultaneously provide additional state funding to replace local revenue lost by compressing local school tax rates. This should be accompanied by increasing homestead exemptions to make sure people get the lion's share of the savings rather than corporations. And the state should provide a proportional rebate to renters so they will also share in the property tax reductions.

PROCLAMATION BY THE SPEAKER
CREATION OF HOUSE SELECT COMMITTEE ON
EDUCATIONAL OPPORTUNITY AND ENRICHMENT

Pursuant to Rule 1, Section 16(b), Rules of the House of Representatives, I, Dade Phelan, Speaker of the House of Representatives, hereby create the House Select Committee on Educational Opportunity and Enrichment.

SECTION 1.  PURPOSE AND JURISDICTION.
The committee is created to consider issues and matters that broadly affect educational opportunities for K-12 students in Texas and make recommendations for:
(1)  Ensuring all Texas youths enjoy equal educational opportunity and the freedom to obtain a quality education, regardless of circumstance;
(2)  Improving outcomes for Texas public school students and meaningfully supporting educators and educational institutions; and
(3)  Modernizing assessment and accountability measures for Texas schools educating K-12 students.

SECTION 2.  REPORTING.
The committee shall submit an initial report, no later than August 11, 2023, in the same manner as an interim study committee under Rule 4, Section 61, Rules of the House of Representatives. As necessary, the committee may submit additional reports in the same manner.

The committee shall have 15 members and shall have the same authority and duties conferred on standing committees under the Rules of the House of Representatives. The committee expires on the date the 89th Legislature convenes.

PROCLAMATION BY THE SPEAKER
CREATION OF HOUSE SELECT STUDY COMMITTEE ON
SUSTAINABLE PROPERTY TAX RELIEF

Pursuant to Rule 1, Section 17, and Rule 4, Sections 57 and 58, Rules of the House of Representatives, I, Dade Phelan, Speaker of the House of Representatives, hereby create the House Select Study Committee On Sustainable Property Tax Relief.

SECTION 1.  PURPOSE AND JURISDICTION.
The committee is created to consider issues and matters that broadly affect property taxes and make recommendations for sustainable property tax relief for Texas property owners. The committee shall examine all elements of state policy that influence the property tax burden on Texas property owners. Specifically, the committee shall:
(1)  Evaluate the dynamic effects of tax rate compression, limits on taxable value, and homestead exemption increases to maximize savings to property owners;
(2)  Study the viability and sustainability of eliminating maintenance and operations taxes by 2035;
(3)  Examine historical rates of appraisal increases and recommend methods to reduce the tax burden of appraisal increases on all real property; and
(4)  Examine the long-term value of homestead exemptions to Texas homeowners in conjunction with the impact of appraisal increases.

SECTION 2.  REPORTING.
The committee shall submit a final report under Rule 4, Section 61, Rules of the House of Representatives.
