HB 727 - REMARKS

REPRESENTATIVE ROSE: I want to thank everyone for bearing with me as we postponed HB 727. One of the reasons I postponed it was because several members wanted to continue to have conversations about it and I appreciate those who I've had those conversations with. Today, I want to finish the process and I want to just tell you a little bit about why I'm so passionate about this. Prior to running for office I worked in correctional mental health so a majority of my career has been working with inmates who were in the psychiatric department and so that's why I understand this issue. I know there are some concerns about bipolar being a part of it. And so I understand your concerns and because the body is willing to work with me on this bill, I think we can start from somewhere. So I have an amendment—myself, Representative Leach, and Representative Moody—to remove bipolar.

Amendment No. 1

Representatives Rose, Leach, and Moody offered the following amendment to HB 727:

Amend HB 727 on third reading, in added Article 46D.001, Code of Criminal Procedure, by striking "schizophrenia, a schizoaffective disorder, or a bipolar disorder" and substituting "schizophrenia or a schizoaffective disorder".

AMENDMENT NO. 1 - REMARKS

REPRESENTATIVE LEACH: Members, I appreciate your patience with this bill and certainly to Vice-chair Rose, as well. Members, this amendment is in front of you, it's on your system, it's very clear. It simply strikes the word "bipolar disorder" under the bill. And so the bill will now just read schizophrenia or schizoaffective disorder. Bipolar is out of the bill.

REPRESENTATIVE SLATON: Representative Leach, why was the decision just to strike "bipolar"?

LEACH: Because that's the way we drafted the amendment, Mr. Slaton.

SLATON: Well, was there any—what was the decision-making in choosing that one over the others? Just wondering.

LEACH: That was a concern addressed. There was concern expressed to us on the floor last week and then, Representative Slaton, many of us have actually been in productive, collaborative discussions amongst ourselves, with the bill's author, with folks who supported the bill, and those who were not comfortable with it. This seemed to be the major concern and we thought, by way of this amendment, it would address those concerns that were held by many members.

SLATON: Representative Leach, do you think we have more mental health options available to people now than we did 10, 20, 30, 40 years ago?

LEACH: Representative Slaton, this amendment is very clear. This is about striking the word "bipolar" from the text of the bill, that's all this amendment does. I'm not real interested in a larger discussion about issues that are not relevant to this amendment. It's very clear and straightforward. If you have questions about the amendment itself, I'm happy to answer them.

SLATON: Well, I believe it is substantive to this. We do have more mental health available in what we offer to residents of Texas. I would like to ask you, are you aware of who Jeffrey Dahmer was?

LEACH: Representative Slaton, yes.

SLATON: Are you aware of one of the mental conditions they diagnosed him with when he was in prison?

LEACH: I'm not aware of the specific facts of his case, no.

SLATON: Schizophrenia. So if this amendment passes, someone with schizophrenia who has had interactions or diagnosed with mental health kills people, they could be not subject to the death penalty. Jeffrey Dahmer killed over 20 people and he had schizophrenia. And if this amendment gets on, or it doesn't—if this bill were to pass, do you think there's a chance people that do grotesque acts of violence, like Jeffrey Dahmer, could get away from the death penalty?

LEACH: Representative Slaton, I believe very strongly that in our criminal law when an offense is committed, whether it's a capital offense or otherwise, the defendant has to have not only done the act, the actus reus, but has the requisite mental state, the mens rea as well. If someone does not have the mens rea then they should not be convicted of a crime, or sentenced to capital punishment. Representative Slaton, let's be very, very clear. In a case where someone is diagnosed with schizophrenia or schizoaffective disorder at the time the crime was committed, that person can still receive life in prison, can be convicted of the capital offense and can still receive life in prison. The question here, Representative Slaton, is whether they should be eligible for the death penalty and put to death by the state. I trust our judges. I trust our juries. I trust our medical professionals. I trust the system to work, and I believe this bill strengthens the system not weakens it.

REPRESENTATIVE OLIVERSON: Chairman, I appreciate your work on this. I appreciate this amendment. Are you aware that in the DSM, which is the manual that psychiatrists use to classify mental illness, schizophrenia and schizoaffective disorders are classified as disorders that affect thought and the perception of reality whereas bipolar is classified as a mood disorder? It is not a thought or reality perception affecting disorder. It is a disorder of elevation and depression. Were you aware of that?

LEACH: Yes. My intense medical studies have led me—yes, I'm aware. I was going to say exactly what you just said, but you just said it better than me.

OLIVERSON: Would you agree that this is a substantive change if the intent of the bill and the amendment is to separate out individuals who may not be able to perceive reality from non-reality? Separating out disorders of thought from disorders of mood is a substantive change to the nature of this bill, and I would say in a positive way.

LEACH: I agree. Again, well said.

HB 727 - REMARKS

REPRESENTATIVE CAIN: The American criminal justice system is based on and derived from several implicit, if not explicit, assumptions. A few of those assumptions are that everyone except children under legal age and those of certain mental states or conditions know the difference between right and wrong. Due to the operations of God's temporal conserving upon our conscience, we can tell the difference between acts of right and acts of wrongdoing. To quote Mark 7:21, Christ said, "for it is from within, out of a person's heart, that evil thoughts come." Those that choose to do wrong should probably be punished, but the state may only punish people for the outward acts of crime they commit.
Punishment is the price we pay for our freedoms to choose evil deeds over good deeds. For Christians, one aspect of worshipping our God is understanding that his laws, which are perfect, are given to safeguard his people. God established rules of justice to prevent unfair, arbitrary, erroneous, or dishonest treatment of an individual. These judicial requirements are things that we know today as procedural due process as substantive due process. In the book of Deuteronomy, Moses outlines God's plan for Israel's spiritual and community life. Deuteronomy 17:2-13, God focuses on Israel's judicial process, putting systems in place to deal fairly and respectfully with those accused of crimes. One such procedure was to require two or three witnesses for a criminal conviction. We find that in Deuteronomy and in Numbers, one saying that on testimony of two to three witnesses a person should be put to death, but no one should be put to death on just one. If this were the law, the death penalty would be even more rare than what this bill seeks to do.
Jesus famously calls his disciples to a lifestyle of mercy and love that goes far beyond the strict retributive justice of the Mosaic Law, saying, "you have heard that it was said, 'an eye for an eye and a tooth for a tooth', but I say to you, do not resist the one who is evil. But if anyone slaps you to the right cheek, turn to him the other as well."
There's two stories from the gospels that are particularly relevant. Guys, real quick, for any discussion of Christ and capital punishment. The first of these stories, a group of religious leaders bring Jesus an adulterous woman, saying in the law, Moses commanded us to stone such a woman. So what do you say? Jesus neither declares the woman innocent nor questions the Pharisees' interpretation of the Mosaic Law. She was supposed to be put to death. Rather he states, "let him who is without sin be among the first to throw a stone at her." After the crowds dispersed, Jesus says to the woman, "neither do I condemn you. Go and sin no more. "The story beautifully illustrates the restorative justice of Jesus, which seeks to redeem sinners from, rather than giving to, what they deserve. The second we see is Christ on the cross and what he does for us there.
Every Christian, I would say, rejoices to be set free from their well-sentenced deserving of eternal death. For those reasons, some Christians completely oppose the death penalty. Some believe it should only be done in rare circumstances. Look, I believe that plenty of Christians have plenty of reasons to not just be pro-life but whole life concerned with any situation the collective force of government takes the innocent human life whether they're born or unborn. Furthermore, as a Christian, I believe that we are commanded to spread the gospel of Jesus Christ. The longer, I think, these people sit in jail for their lifetime, the more opportunities, I think, that they're able to share the gospel with them and bring them back to faith with their father. My point is, though, I believe that people of faith can arrive at different conclusions on this issue. When you vote, I ask that you vote based on your faith and not worry about other people.

SLATON: Mr. Cain, are you aware of Jeffrey Dahmer? Who he was? What he did?

CAIN: I am very aware of who he is.

SLATON: How many people did he kill?

CAIN: I don't know how many people he killed, but I am deserving of death for my sins, as well. For me, personally, this is how I interpret it and I come along with it. I'm not telling you that you're wrong if you disagree with me.

SLATON: Are you aware he killed over 20 people?

CAIN: Yes.

SLATON: Are you aware that he was diagnosed with schizophrenia?

CAIN: Sure.

SLATON: Does it concern you that, with the passage of this bill, it makes it possible for someone who commits the heinous acts that Jeffrey Dahmer did, it would make it to where they would not be subject to the death penalty? It just takes it off the table completely. Does that concern you?

CAIN: I think you heard what I just read, though, and I tried to rush through some of it. But, like I said, there's an economic argument––it's cheaper that they sit there for the rest of their lives. Two, it gives an opportunity to restore them just as I've been restored for the things that I'm deserving of death for, as well.

SLATON: Like you, I'm aware there's two deaths. There's physical death and there's the spiritual. What I'm talking about is, in line with this bill in regards to punishment here on Earth. Anyway, thank you for answering my questions.
