HB 2, A bill to be entitled An Act relating to providing property tax relief through the public school finance system and property tax appraisal and administration.
HB 2 - REMARKS
REPRESENTATIVE RAMOS: Following up on the questions that we asked yesterday—you discussed that this appraisal cap applies to real property owners. The owners of this real property are not all necessarily Texas residents, correct?
REPRESENTATIVE MEYER: It applies to all real property owners, yes, ma'am.
RAMOS: Thank you. So all property owners—which means these property owners could be all over the world, not necessarily Texas property owners, correct?
MEYER: All real property owners, yes, ma'am.
RAMOS: Okay, and that also includes rental property as you discussed yesterday?
MEYER: Yes, ma'am.
RAMOS: So yesterday we discussed that the landlords would receive—and in the research—five percent appraisal cap benefits, correct?
MEYER: Correct.
RAMOS: And in the discussion yesterday with Representative Thierry it was referenced that there are high rental prices, people can't afford to rent properties because of the increase in rental prices, correct?
MEYER: I don't know if I exactly said that. I believe I was saying that rentals and the cost of renting has continued to go up and I believe that is directly linked to obviously many factors, but certainly skyrocketing appraisals are part of it.
RAMOS: Thank you. So the cost of rent has skyrocketed, as you reference, and we know in all of our districts that that's the case. Could you point me to what part of this bill indicates that, or requires, the landlords who are receiving these tax savings—what part of your bill requires that these savings be passed on to renters?
MEYER: By applying a five percent appraisal cap to rental properties, to apartment buildings, to multifamily units and so forth, then these landlords—these owners of these properties—will not see the skyrocketing appraisals which they are currently seeing and passing along to renters. So therefore, with only the five percent cap they will not be passing along the appraisal increases to their renters.
RAMOS: Okay understood, but is there a part in your bill that requires that savings for the property owner to pass on to the small business owner that's leasing that property or the renter who is renting that property? What part of your bill requires that the Texan who lives and works in Texas will receive the savings that are provided to the property owner that may or may not live in the Texas?
MEYER: I believe that the five percent cap, as I've stated, on all real property—the renter will see a benefit from that.
RAMOS: We believe it, but we didn't write it down and we don't explicitly state it in this bill, correct?
MEYER: The explicit statement is in the bill with the five percent cap on all property.
RAMOS: But no requirement that that cap needs to be passed on to the savings of the tenant, correct?
MEYER: We have a five percent cap on all real property and I believe renters will benefit.
RAMOS: So there is no statement requiring that.
MEYER: I believe the five percent cap on all real property is that statement, Ms. Ramos.
RAMOS: Okay, but we don't know that for sure. If I'm a landlord, my job is to make money. So we don't know with this bill that I, as a landlord, am going to have to give that money to Joe Smith and lower rent. We don't know that, correct? We don't know that.
MEYER: I believe that the five percent cap on all real property and those that are rental homes, as I said, multifamily units—I believe that will then be passed on to the renters.
RAMOS: Okay, thank you. And in the research that's been provided or what have you, we know for example, according to the Dallas Central Appraisal District—which you and I are both in Dallas—more than 90 percent of the Dallas County properties benefitted from this 10 percent cap were north of Interstate 30 which are some of the wealthiest neighborhoods in the city. Did you know that more than half of the benefit of this cap goes to families with income over $97,000 a year?
MEYER: No, ma'am, I'm not advised. This cap benefits all Texans and I don't think that you can, by whatever metric you are going off of, try to apply it to just a specific segment. The triple net leases pass savings on to renters, the caps will pass it on to homeowners, the caps will pass it on to business owners. Small business owners in your district and my district will benefit. Homeowners in your district and my district will benefit and renters in your district and my district will benefit.
RAMOS: May benefit, but not will benefit, correct?
MEYER: I believe they will benefit.
RAMOS: So going back to the benefit to families—the wealth disparity, right—it benefits families that make more than $97,000 a year and the median income for Black and Hispanic households in Texas doesn't even cross to $45,000 a year. We know that the average salary in the State of Texas, median income, is about $35,000 across the State of Texas. Would you agree that lowering the appraisal cap even more would put a greater burden on the majority of taxpayers who do have those incomes lower than $90,000?
MEYER: I would not agree.
RAMOS: Okay. Do you agree that appraisal caps favor those with generational wealth and significant assets, like property? So if I am a Texan who lives and works here but I don't necessarily own any real property, I won't necessarily be seeing the benefit to this?
MEYER: No, ma'am, I would disagree. I believe this benefits not only homeowners, business owners, but as I stated previously, I believe it will benefit renters as well due to the appraisal caps.
RAMOS: Okay, and in the research it also indicates that appraisal caps give no benefits to new homeowners and unfairly taxes them at higher rates than established homeowners. My concern is that the younger generation—it's inaccessible, it is too expensive for them to even buy homes. Do you agree with the studies that this unfairly and disproportionately affects potential new homeowners versus those who are established?
MEYER: I would disagree. I believe it benefits anyone who owns a home, for sure, and especially on a go-forward basis that, you know, as a homeowner myself, that it can only go up five percent on the taxable value—the appraisal can still go up—but the taxable value can only go up five percent. It benefits all homeowners.
RAMOS: Five percent of a $1 million home, which is the average price of a home in your district, is a lot more than five percent of the homes in my district that are below the state average, correct? I get more money out of five percent on a $1 million home than five percent on a $150,000 home.
MEYER: Yes, ma'am, that's math. Sure.
RAMOS: That is math and the math shows that the wealthier will benefit the most.
MEYER: No, it does not. In fact, it shows because this five percent cap does not say "over a particular value you get the five percent and only if you—it does not." This is something that applies to all home values. This applies to all real property, and so all Texans who own property will benefit from this bill.
RAMOS: Okay, so if I vote for this bill, I will not only be giving significant tax relief to non-Texans with no guarantee their renters will receive relief, but I will also be giving a greater tax relief to the wealthiest families in our state over our working class families. The wealthiest families that own a $1 million home will receive a greater benefit than those that have a $100,000 home, correct?
MEYER: Ms. Ramos, if you want to vote against tax relief for your constituents, that is your prerogative. If you want to vote against increasing public education funding to over 50 percent, that is your prerogative. If you want to vote against increasing recapture throughout the State of Texas, that is your prerogative.
RAMOS: It is also my prerogative to vote for Texas homeowners, Texas property owners, and voting for this bill will help the $1 million homeowners in your district and the property owners in Saudi Arabia, China, Mexico, and all over the world except for those that live, work, and survive here in the State of Texas. So thank you for benefitting the "save the rich" through your bill.
REPRESENTATIVE HOWARD: Chair Meyer, we had a little conversation a while ago and I'd like to point out some clarifying language here about what I think is actually good about this bill. I also am not a fan of the cap, but what you've put in here for the tax rate compression is huge.
MEYER: It is.
HOWARD: I want to clarify with you, yes? It's $12 billion, is that correct?
MEYER: That is correct.
HOWARD: And you and I both worked last session on legislation that would clarify, as we move forward with property tax compression, that it be proportionally applied to those who have their taxes frozen. Those that are over 65 and those with disabilities. Is that not correct?
MEYER: It would certainly help them all through compression and one point of clarification: the cap would apply to those over 65 as it relates to city and county—over 65, their value is only frozen as it relates to ISD taxes—so the cap would apply to them as far as it relates to their city and county taxes as well.
HOWARD: The bottom line is that with the way that we have structured things after SJR 4 from last session—that those that have their taxes frozen, that are over 65 and those with disabilities, get a proportionate reduction of their school property taxes as a result of that.
MEYER: Absolutely. Yes, ma'am.
HOWARD: So what we're talking about here—and thank you for that—the part of your bill that has to do with a 15-cent rate compression will actually apply to those that are over 65 and those with disabilities. It will apply to homeowners. It will apply to businesses. It will apply to all people, all entities that own property in the State of Texas, is that not correct?
MEYER: That is correct.
HOWARD: So actually then, even though I voted against this yesterday, I am going to vote for it today because this is a huge amount of property tax relief that will apply across the board to every Texan who has property in this state. Including those over 65 and those with disabilities, is that not correct?
MEYER: That is correct, Representative Howard, and I appreciate your support.
REPRESENTATIVE BERNAL: This, in large part, is a continuation of some of the work that began in HB 3, is that correct?
MEYER: Yes, sir, with a lot of your great work and effort on that.
BERNAL: Thank you for that. One of the features of HB 3, though imperfect and I will acknowledge that, was there was an attempt to create as little a distance as possible between the districts and the expenditures per student of, let's say, the wealthiest districts and the property-poor districts. And there was a mechanism put in place to keep that distance as small as possible. My understanding is that your bill continues that. That there was an effort put in place to make sure that even though the state is different, districts are different, property wealth across the state is different—that there is an effort to keep that tether as close as possible, but certainly not to exacerbate it. And that's one of the features of the bill that gives people like me some sort of comfort. Is that correct?
MEYER: That is correct. We do not change the band at all.
BERNAL: And one of the things that we have to be vigilant of and make sure of as the bill goes throughout the entire process is to make sure that band isn't widened. And that's one of the features of the house bill that is unique, is that correct?
MEYER: That is correct.
REPRESENTATIVE ISAAC: Are you aware that there are a lot of elderly people here in Texas that are living on the poverty line or below the poverty line and that are being taxed out of their home, a home that they have paid for, but they can no longer maybe afford their home because of the property taxes?
MEYER: That is one of the issues that we are addressing within this bill by providing the largest tax cut in the history of the State of Texas.
ISAAC: Elderly people living at the poverty line or below the poverty level—this will help them stay in their homes, is that correct?
MEYER: That is correct.
ISAAC: Thank you for this bill.
