SB 240, A bill to be entitled An Act relating to workplace violence prevention in certain health facilities.

SB 240 was considered in lieu of HB 112.

Representative Howard offered the following amendment to SB 240:

Amend SB 240 (house committee report) as follows:
(1)  On page 2, line 14, immediately following the underlined semicolon, strike "and".
(2)  On page 2, between lines 14 and 15, insert the following:
(2)  except as provided by Subsection (c), one physician licensed to practice medicine in this state who provides direct care to patients of the facility; and
(3)  On page 2, line 15, strike "(2)" and substitute "(3)".
(4)  On page 2, between lines 16 and 17, insert the following:
(c)  If a facility described by Section 331.001(3)(A) does not have on staff at least one physician described by Subsection (b)(2), the facility is not required to include a physician on the committee.
(5)  On page 2, line 17, strike "(c)" and substitute "(d)".
(6)  On page 4, lines 8 and 9, strike ", including temporary employees,".

Amendment No. 1

Representative Tinderholt offered the following amendment to HB 1898:

Amend HB 1898 (house committee printing) on page 2, between lines 2 and 3, by inserting the following:
(b-1)  The commission may not award a grant under the grant program to a children's hospital that provides services, medications, or procedures for transitioning a child's biological sex as determined by the sex organs, chromosomes, and endogenous profiles of the child or affirming the child's perception of the child's sex if that perception is inconsistent with the child's biological sex.

Amendment No. 1 - Point of Order

Representative Geren raised a point of order against further consideration of Amendment No. 1 under Rule 11, Section 2, of the House Rules. The speaker sustained the point of order, announcing his decision to the house as follows:

Mr. Geren raises a point of order against further consideration of the Tinderholt Amendment (Amendment No. 1) under Rule 11, Section 2, on the grounds that the amendment is not germane.
The bill authorizes grants to children's hospitals for mental and behavioral health services to children. The amendment would prohibit the award of the grants authorized by the bill if the hospital provided certain services, medications, or procedures for children that are not limited to mental and behavioral health. The class embraced by the amendment is broader than the class covered by the bill. E.g., 87 H. Jour. 2d C.S. 229-230 (2021). The amendment is not germane.
Accordingly, the point of order is well-taken and sustained.

The ruling precluded further consideration of Amendment No. 1.
