CSSB 1445, A bill to be entitled An Act relating to the continuation and functions of the Texas Commission on Law Enforcement; authorizing a fee.

CSSB 1445 - REMARKS

REPRESENTATIVE MOODY: I do want to briefly talk about the issue of wandering officers that's in the bill and what gets reported when a peace officer separates from a law enforcement agency. Under current law, when an officer leaves an agency, for whatever reason, they are assigned a discharge category on the F-5 form. Is that correct?

REPRESENTATIVE GOLDMAN: That's correct.

MOODY: The Sunset Commission—in the process y'all went through—recommended that we get rid of the F-5 discharge categories. So the bill repeals those provisions in current law, is that correct?

GOLDMAN: That's correct. Yes, sir.

MOODY: And there are other provisions of the bill that you presented to the body that would kick in when an officer separates from a law enforcement agency. Is that also correct?

GOLDMAN: That is correct.

MOODY: For example, there is a new misconduct reporting system. If an officer is separated for misconduct, on page 23 of your bill, it says that they have to submit a report about the misconduct to TCOLE no later than 30 days after the officer leaves the agency. Is that correct?

GOLDMAN: Correct.

MOODY: On page 27 of the bill, it states an agency will have to turn over the officer's entire personnel file to TCOLE once that officer separates from the agency. Is that correct?

GOLDMAN: That's correct.

MOODY: In both of these new provisions dealing with personnel files and misconduct reporting, TCOLE has discretion to make rules and model policies for these particular operations. Is that correct?

GOLDMAN: That's correct.

MOODY: I had previously filed an amendment—it's been on file, I've withdrawn it. But I was concerned about what kind of data and information local agencies would be reporting about officer separations. Are you aware that over 40 states have some kind of requirement for agencies to describe how an officer separated?

GOLDMAN: I do understand that. Yes, sir.

MOODY: Is it your understanding that under this bill TCOLE has the discretion to prescribe the manner in which officer separations are reported, like the vast majority of other states?

GOLDMAN: Yes.

MOODY: Is it also correct to say that TCOLE's hands are not tied in telling agencies to report to TCOLE how an officer left the agency?

GOLDMAN: That's my understanding. Yes, sir.

MOODY: And just to be extra clear, it is not your intention for TCOLE to be unable to require basic reporting on how an officer separates from an agency?

GOLDMAN: Absolutely not.

MOODY: Thank you, Mr. Goldman. I appreciate all your work on this bill and answering my questions.

Mr. Reynolds raises a point of order against further consideration of CSSB 18 under Rule 4, Section 32(c)(2), on the grounds that the bill analysis is substantially or materially misleading.
The bill makes substantial changes governing the award of tenure and the administration of the tenure process at public institutions of higher education. The bill does this by amending the current law which only specifies the post-tenure performance evaluation process. Under that current law, governing boards are required to file only their rules governing the evaluation process with the higher education coordinating board. The bill amends this filing requirement to require governing boards to file all tenure-related policies and procedures authorized by the bill.
The bill analysis "inaccurately states and describes" the filing requirement imposed by the bill as applying only to policies and procedures related to the evaluation process. See 79 H. Jour. 2481-2482 (2005). Under the long-standing precedent announced by Speaker Craddick, this inaccuracy is substantially and materially misleading and violates the rule. See id. at 2482.
Accordingly, the point of order is well-taken and sustained.

SECTION ____.01.  Section 33.06, Tax Code, is amended by amending Subsection (f) and adding Subsection (f-1) to read as follows:
(f)  Except as provided by Subsection (f-1) and notwithstanding any other provision [Notwithstanding the other provisions] of this section, if an individual who qualifies for a deferral or abatement of collection of taxes on property as provided by this section dies, the deferral or abatement continues in effect until the 181st day after the date the collector for the taxing unit delivers a notice of delinquency of the taxes following the date the surviving spouse of the individual no longer owns and occupies the property as a residence homestead if:
(1)  the property was the residence homestead of the deceased spouse when the deceased spouse died;
(2)  the surviving spouse was 55 years of age or older when the deceased spouse died; and
(3)  the property was the residence homestead of the surviving spouse when the deceased spouse died.
(f-1)  Notwithstanding any other provision of this section, if an individual who qualifies for a deferral of the collection of taxes on property as provided by this section dies without being survived by a spouse and the ownership of the property is transferred to another person by inheritance or under a will, the deferral continues in effect for a period equal to the period that the deferral was in effect during the life of the individual.
SECTION ____.02. Section 33.06, Tax Code, as amended by this article, applies only to the deferral under that section of the collection of ad valorem taxes on property of an individual who qualifies for the deferral and dies on or after September 1, 2023.

ARTICLE ____. RELIANCE ON APPRAISAL SUBMITTED BY PROTESTING PROPERTY OWNER
SECTION ____.01.  Section 41.43, Tax Code, is amended by amending Subsections (a) and (a-2) and adding Subsection (a-6) to read as follows:
(a)  Except as provided by Subsections (a-1), (a-3), (a-6), and (d), in a protest authorized by Section 41.41(a)(1) or (2), the appraisal district has the burden of establishing the value of the property by a preponderance of the evidence presented at the hearing. If the appraisal district fails to meet that standard, the protest shall be determined in favor of the property owner.
(a-2)  To be valid, an appraisal filed under Subsection (a-1) or (a-6) must be attested to before an officer authorized to administer oaths and include:
(1)  the name and business address of the certified appraiser;
(2)  a description of the property that was the subject of the appraisal;
(3)  a statement that the appraised or market value of the property:
(A)  was, as applicable, the appraised or market value of the property as of January 1 of the current tax year; and
(B)  was determined using a method of appraisal authorized or required by Chapter 23; and
(4)  a statement that the appraisal was performed in accordance with the Uniform Standards of Professional Appraisal Practice.
(a-6)  Notwithstanding Subsection (a-1), if in the protest relating to a parcel of residential real property the property owner files with the appraisal review board and, not later than the 14th day before the date of the first day of the hearing, delivers to the chief appraiser a copy of an appraisal of the property performed not later than the 180th day before the date of the first day of the hearing by an appraiser certified under Chapter 1103, Occupations Code, that supports the appraised or market value of the property asserted by the property owner, the appraisal review board shall:
(1)  determine the protest in favor of the property owner; and
(2)  issue an order changing the property's appraised or market value in the appraisal records to the value determined by the appraisal of the property filed by the property owner.
SECTION ____.02.  Section 37.10(c)(4), Penal Code, is amended to read as follows:
(4)  An offense under this section is a Class B misdemeanor if it is shown on the trial of the offense that the governmental record is a written appraisal filed with an appraisal review board under Section 41.43(a-1) or (a-6), Tax Code, that was performed by a person who had a contingency interest in the outcome of the appraisal review board hearing.
SECTION ____.03.  The changes in law made by this article apply only to a protest under Chapter 41, Tax Code, for which a notice of protest is filed on or after the effective date of this article.

SB 2601, A bill to be entitled An Act relating to payment of costs related to the relocation of certain utility facilities for state highway projects.

Amend SB 2601 (house committee printing) by striking SECTION 1 of the bill (page 1, line 5, through page 2, line 8) and substituting the following:
SECTION 1.  Section 203.092, Transportation Code, is amended by adding Subsection (a-5) to read as follows:
(a-5)  Notwithstanding another provision of this section, a utility shall make a relocation of a utility facility required by improvement of the state highway system at the expense of this state if the commission determines that the utility:
(1)  is a water supply or sewer service corporation organized and operating under Chapter 67, Water Code; and
(2)  would not be able to receive a state infrastructure bank loan under Subchapter D, Chapter 222, to finance the cost of the relocation, or is otherwise unable to finance that cost.

Amend SB 1677 (house committee report) by adding the following appropriately numbered SECTIONS to the bill and renumbering subsequent SECTIONS of the bill accordingly:
SECTION ____.  Section 533.00255(a), Government Code, is amended to read as follows:
(a)  In this section:
(1)  "Behavioral [, "behavioral] health services" means mental health and substance use [abuse] disorder services.  The term includes intensive outpatient services and partial hospitalization services.
(2)  "Intensive outpatient services" means outpatient treatment services, including treatment services for substance use disorders, depression, eating disorders, and other mental health conditions that do not require detoxification or 24-hour supervision, provided to patients who require a time-limited, multifaceted array of services, structures, and supports by a team of clinical staff capable of providing, at a minimum, the following services:
(A)  individual counseling;
(B)  group counseling;
(C)  family counseling;
(D)  motivational enhancement training; and
(E)  relapse prevention, drug refusal, and coping skills training.
(3)  "Partial hospitalization services" means distinct and organized intensive ambulatory treatment services provided for periods of not more than 24 hours at a location other than a patient's home or in an inpatient or a residential care setting.  The term includes the services described by 42 C.F.R. Section 410.43(a)(4).
SECTION ____.  If before implementing any provision of this Act a state agency determines that a waiver or authorization from a federal agency is necessary for implementation of that provision, the agency affected by the provision shall request the waiver or authorization and may delay implementing that provision until the waiver or authorization is granted.
