SECTION ____. Chapter 26, Tax Code, is amended by adding Section 26.0445 to read as follows:
Sec. 26.0445. TAX RATE ADJUSTMENT FOR PUBLIC SAFETY EXPENDITURES. (a) In this section, "public safety expenditures" for a tax year means the amount of expenditures derived from maintenance and operations tax revenue made by a taxing unit in the period beginning on July 1 of the year preceding the tax year for which a tax is adopted and ending on June 30 of the tax year for which the tax is adopted on costs to equip, train, house, supervise, compensate, and provide other benefits to individuals who provide firefighting services, law enforcement services, jail and detention services, and emergency medical services.
(b) This section applies only to:
(1) a municipality or county with a population of 75,000 or more that is not a special taxing unit; or
(2) an emergency services district created under Chapter 775, Health and Safety Code, that is not a special taxing unit.
(c) If the public safety expenditures of a taxing unit to which this section applies exceed the amount of those expenditures for the preceding tax year, the no-new-revenue maintenance and operations rate for the taxing unit is increased by the rate computed according to the following formula:
(Current Tax Year's Public Safety Expenditures - Preceding Tax Year's Public Safety Expenditures) / (Current Total Value - New Property Value)
(d) The taxing unit shall include a notice of the increase in the no-new-revenue maintenance and operations rate provided by this section, including a description and amount of public safety expenditures, in the information published under Section 26.04(e) and, as applicable, in the notice prescribed by Section 26.06 or 26.061.

SECTION 9.____. (a) Subchapter A, Chapter 102, Code of Criminal Procedure, is amended by adding Article 102.006 to read as follows:
Art. 102.006. FEES IN EXPUNCTION PROCEEDINGS. (a) In addition to any other fees required by other law and except as provided by Subsections (b) and (b-1), a petitioner seeking expunction of a criminal record in a district court shall pay the following fees:
(1) the fee charged for filing an ex parte petition in a civil action in district court;
(2) $1 plus postage for each certified mailing of notice of the hearing date; and
(3) $2 plus postage for each certified mailing of certified copies of an order of expunction.
(a-1) In addition to any other fees required by other law and except as provided by Subsection (b), a petitioner seeking expunction of a criminal record in a justice court or a municipal court of record under Chapter 55A shall pay a fee of $100 for filing an ex parte petition for expunction to defray the cost of notifying state agencies of orders of expunction under that chapter.
(b) The fees under Subsection (a) or the fee under Subsection (a-1), as applicable, shall be waived if the petitioner seeks expunction of a criminal record that relates to an arrest for an offense of which the person was acquitted, other than an acquittal for an offense described by Article 55A.151, and the petition for expunction is filed not later than the 30th day after the date of the acquittal.
(b-1) The fees under Subsection (a) shall be waived if the petitioner is entitled to expunction:
(1) under Article 55A.053(a)(2)(A) after successful completion of a veterans treatment court program created under Chapter 124, Government Code, or former law; or
(2) under Article 55A.053(a)(2)(B) after successful completion of a mental health court program created under Chapter 125, Government Code, or former law.
(c) A court that grants a petition for expunction of a criminal record may order that any fee, or portion of a fee, required to be paid under Subsection (a) be returned to the petitioner.
(d) This section expires January 1, 2026.
(b) This section takes effect immediately if this Act receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this section takes effect on the effective date of this Act.
SECTION 9.____. (a) Notwithstanding Section 19, SB 1760, Acts of the 89th Legislature, Regular Session, 2025, Section 1023.0071, Estates Code, as added by Section 5, SB 1760, Acts of the 89th Legislature, Regular Session, 2025, takes effect January 1, 2026.
(b) This section takes effect immediately if this Act receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this section takes effect on the effective date of this Act.
SECTION 9.____. (a) Section 23.303, Government Code, as added by SB 293, Acts of the 89th Legislature, Regular Session, 2025, and effective September 1, 2025, is amended by amending Subsections (a) and (b) and adding Subsection (b-1) to read as follows:
(a) The business court, a district court, or a statutory county court shall, with respect to a motion for summary judgment:
(1) set the motion for a hearing by [hear] oral argument [on the motion] or by submission on a date [consider the motion without oral argument] not later than:
(A) the 60th [45th] day after the date [the response to] the motion was filed; or
(B) the 90th day after the date the motion was filed:
(i) if the court's docket requires a hearing on a date later than the 60th day after the date the motion was filed;
(ii) on a showing of good cause; or
(iii) if the movant consents; and
(2) file with the clerk of the court and provide to the parties a written ruling on the motion not later than the 90th day after the date the motion was heard [argued] or considered.
(b) The [If a motion for summary judgment is considered by a court described by Subsection (a) without oral argument, the] court shall record in the docket the date the motion was heard or considered [without argument].
(b-1) Subsections (a) and (b) do not apply to a motion for summary judgment that is withdrawn.
(b) Section 23.303, Government Code, as amended by this section, applies only to a motion for summary judgment filed on or after the effective date of this Act. A motion for summary judgment filed before the effective date of this Act is governed by the law in effect on the date the motion was filed, and that law is continued in effect for that purpose.

AMENDMENT NO. 1 - REMARKS
REPRESENTATIVE COLLIER: Okay, so my question surrounds whether dashcam video would still be subject to public disclosure even if it is part of a complaint that has been filed by the public against an officer and that complaint is deemed "unsubstantiated."
REPRESENTATIVE HEFNER: So dashcam footage—we're not affecting that in any way in this bill. Dashcam—or bodycam—footage is maintained and governed by its own section of law. And we're not affecting that in any way.
COLLIER: Okay. The reason why I'm concerned is that your definition does not explicitly state what you're telling us, so I'm just trying to get it included into the bill to make sure that what you say—what you mean it to—
HEFNER: Yes, but what the bill says is "any document or record not required by law." So anything that is already policed by—or governed by—existing law, we're not changing. Bodycam footage and dashcam footage we are not touching in this bill in any way.
COLLIER: And what about use-of-force reports?
HEFNER: Use-of-force reports? I mean, the complaint process that is spelled out in the TCOLE recommendations—if they are substantiated, they will go into the personnel file and be open to public view. But if they are unsubstantiated, they would not be viewable to the public.
COLLIER: Does TCOLE require all complaints regarding use of force—whether they are substantiated or not—to be reported?
HEFNER: Yes, they do. In that same study that was done from last session, TCOLE established the State of Texas model policy on misconduct allegations. So every agency, large and small—no matter how big or small they are—is required to report every complaint to TCOLE, whether they're substantiated or unsubstantiated.
COLLIER: And in that reporting, does TCOLE collect the name of the officer?
HEFNER: Yes. To my knowledge, they collect all the details spelled out in the complaint.
COLLIER: The information that is collected from TCOLE—do they differentiate between whether the complaint was substantiated or not?
HEFNER: Yes. Because of the two files, I guess they would determine if it's substantiated or not and then where that record would be kept.
COLLIER: Well, I'm talking about TCOLE. It's TCOLE collecting the use-of-force complaints, right?
HEFNER: All complaints.
COLLIER: You're saying that they're collecting complaints whether they are substantiated or not. So they're not saying, "Oh, well, this one was found not to be a violation. We're going to remove it." They're just collecting all?
HEFNER: They are going to keep it, and they're going to have a database that's going to maintain all records of all complaints filed. Whether they're substantiated or not, they are still going to keep that complaint and the records of that complaint in a database.
COLLIER: But in their database, do they say, "This one was filed against Officer John Doe or Jane Doe, and it was found not to be substantiated"?
HEFNER: You know, I can confirm that, Representative Collier, but I'm fairly certain that, yes, it would contain the officer's name and all the information related to that complaint.
COLLIER: So then why is it that this information would not be part of that officer's file if it is also being reported to TCOLE?
HEFNER: Well, the purpose of that is to keep people from outside that might be politically motivated or maliciously motivated to defame or discredit that officer. Some things need to be disclosed to the public, and some things do not. We've seen the information that's in these department files used to defame an officer or discredit his integrity when he might have just been coached or might have made a small mistake, and—or she, absolutely—so we don't want those to be used. We want agencies to be free to coach their officers and make them better—to teach them and coach them up without fear of those items of coaching or whatever information they could have tweaked and done better—without that being used against that officer. But if it is substantiated and it rises to that level, then, absolutely, the public should know.
COLLIER: However, my concern is that if it is in the records of TCOLE, why are you trying to hide it in the department file?
HEFNER: Well, like I said, these things are not necessarily hidden. They're still available through lawsuits or criminal investigations. There should be a due process and an exhaustive process to go through to gain access to those, should the need arise.
COLLIER: What is that process?
HEFNER: Well, there can be what they call an in camera review by a judge, where a prosecutor can ask that judge to look into that file and determine whether the information in that file should be released to the public or not. So it's checked by a judge.
COLLIER: And would that process still be applicable under your bill?
HEFNER: Yes.
COLLIER: So you're saying that the department file would be subject to open records requests?
HEFNER: No.
COLLIER: It would not?
HEFNER: It would not be. So there would have to be some sort of other circumstance—a lawsuit or a criminal investigation—where a judge would have to decide that those things were available to the public.
COLLIER: But you're not sure if this information is also available through TCOLE?
HEFNER: TCOLE keeps it all.
COLLIER: They have it all?
HEFNER: Yes.
COLLIER: And you're not sure if the public has access to that?
HEFNER: I'm pretty sure they would not.
COLLIER: So it's your position that this bill does not change what is a "personnel file" under Chapter 143?
HEFNER: Correct. And I would need to clarify that the in camera review for the judge would only be for him to determine whether it could be released via discovery, not necessarily released to the public.
COLLIER: Of course, absolutely. For this amendment—what is your position? That it goes too far or that it doesn't mimic, you believe, the bill—
HEFNER: Well, I have a definition of "department file," and I have a definition of "personnel file," and you're putting "personnel" everywhere, and I think it kind of just clouds the two separate files.
COLLIER: Would you be open to having some type of language added that clarifies specifically that this bill does not change what is disclosable and confidential under Chapter 143? Because that's all I'm trying to clarify.
HEFNER: No, we believe that language is already clarified in the bill, where it says "not otherwise required by law." All of those other laws remain.
COLLIER: Give me the names of all the laws then. What are you talking about? That's how vague your bill is.
HEFNER: Applicable laws—I mean, you can't name all the laws in the code either. Anything that's not included here, in this bill.
COLLIER: Well, that proves my point that that's how vague the bill is.
HEFNER: No, it's not vague. It says certain things that are not required by law are then kept in this department file.
COLLIER: But can you tell me what the "notwithstanding any other law" is? Because we just need to know—
HEFNER: Well, for example, the bodycam footage, which would still be subject to whatever laws it falls under currently. We're not changing that. So that's one example.
COLLIER: But Chapter 143 is another example that you're saying that you're not changing. Is that right?
HEFNER: Chapter 143—we're just taking Chapter 143 and applying it statewide. Twenty-six thousand officers in this state already operate under provisions of 143; they're called civil service cities.
COLLIER: But I'm concerned that your bill goes beyond Chapter 143, and that's why I'm asking you—
HEFNER: It does not.
COLLIER: That broad statement—"notwithstanding any other law"—it could be misinterpreted or misconstrued to mean other laws that you never intended. I'm just trying to get for legislative intent—
HEFNER: We're taking 143, we're copying—
COLLIER: I'm sorry, can I finish my question?
HEFNER: Yes.
COLLIER: I'm trying to establish for legislative intent the "notwithstanding any other law." What does that reference, and what is it that you mean by that? It sounds like Chapter 143 is one of those, but what are the other laws that this is not treading over?
HEFNER: What we're doing is not changing 143. We're taking 143, and we're applying it—
COLLIER: So I just want to make sure—again, let's go back to that section, because this is for legislative intent. You said your bill says, "notwithstanding any other law," and let's go by—can you show me what line that language is on?
HEFNER: Yes, I've read it. Give me just a second. One place you could look is page 2, line 7. It says, any "department file maintained under this section is subject to disclosure only as required by law." That's one place that says that.
COLLIER: Okay. "A department file maintained under this section is subject to disclosure only as required by law, including Chapter 2B and Article 39.14, Code of Criminal Procedure, and Section 511—" All right. Are those the only ones?
HEFNER: No, it just says "including."
COLLIER: Okay, so can you tell us what the other ones are?
HEFNER: No. I'm not advised on all of them, but—
COLLIER: Well, I mean, you want them to comply with your law. Right?
HEFNER: But you're sitting here saying that when I say, "as required by law," I'm supposed to know every law on the books? That's crazy.
COLLIER: Is it?
HEFNER: Yes.
COLLIER: Well, I mean, you wrote the bill. I'm assuming what your intent is. I'm just trying to figure out what it is.
HEFNER: I just told you what my intent was. It's not to conflict with other laws. I mean, this is taking Chapter 143, which is current law. It is being used by 26,000 cops—law enforcement officers—in this state currently. And it applies a consistent framework statewide so that we don't have a mix and match, hodgepodge of managing records across the state.
COLLIER: Okay. So in terms of what would be included in this department file that's not subject to disclosure—if there is a document that would be open to disclosure but could also be included in this department file, which one prevails? Would it be disclosable, or would it be confidential? Because if there's a conflict—
HEFNER: If it's required by law to be disclosable, it's going to be in the personnel file.
COLLIER: Even if it overlaps with this bill?
HEFNER: I think the prevailing rule would be to be disclosable to the public. I mean, I don't think there's going to be a law that's going to say it could be in both. It's either disclosable to the public or it's not.
COLLIER: So if there's a conflict, what I just heard you say—you would err on the side of disclosable. Is that right?
HEFNER: I mean, I would assume.
COLLIER: Is that a yes?
HEFNER: I would assume that would be the case.

SB 15 - POINT OF ORDER
Representative Moody raised a point of order against further consideration of SB 15 under Article III, Section 40, of the Texas Constitution.

The speaker sustained the point of order, announcing his decision to the house as follows:
Representative Moody raised a point of order against further consideration of SB 15 under Article III, Section 40, Texas Constitution on the grounds that the subject matter of the bill is not included in the governor's proclamation.
The proclamation submits the subject of "legislation that protects law enforcement officers from public disclosure of unsubstantiated complaints in personnel files." As pointed out by Mr. Moody, the bill does not deal with personnel files, but instead department files. Under the Occupations Code, a personnel file does not include any unsubstantiated complaints. E.g., Section 1701.435(a)(2)(A), Occupations Code. In addition, the department files authorized under the bill do not solely include unsubstantiated complaints, but also include "any letter, memorandum, or document relating to the license holder not included in a personnel file." Indeed, the background and purpose statement in the bill analysis states that the bill covers "background hiring information" in addition to unsubstantiated complaints. Accordingly, the bill's matter is not embraced by the language of the governor's call.
Accordingly, the point of order is well-taken and sustained.
The ruling precluded further consideration of SB 15.

SECTION 9.____. (a) Subchapter A, Chapter 102, Code of Criminal Procedure, is amended by adding Article 102.006 to read as follows:
Art. 102.006. FEES IN EXPUNCTION PROCEEDINGS. (a) In addition to any other fees required by other law and except as provided by Subsections (b) and (b-1), a petitioner seeking expunction of a criminal record in a district court shall pay the following fees:
(1) the fee charged for filing an ex parte petition in a civil action in district court;
(2) $1 plus postage for each certified mailing of notice of the hearing date; and
(3) $2 plus postage for each certified mailing of certified copies of an order of expunction.
(a-1) In addition to any other fees required by other law and except as provided by Subsection (b), a petitioner seeking expunction of a criminal record in a justice court or a municipal court of record under Chapter 55A shall pay a fee of $100 for filing an ex parte petition for expunction to defray the cost of notifying state agencies of orders of expunction under that chapter.
(b) The fees under Subsection (a) or the fee under Subsection (a-1), as applicable, shall be waived if the petitioner seeks expunction of a criminal record that relates to an arrest for an offense of which the person was acquitted, other than an acquittal for an offense described by Article 55A.151, and the petition for expunction is filed not later than the 30th day after the date of the acquittal.
(b-1) The fees under Subsection (a) shall be waived if the petitioner is entitled to expunction:
(1) under Article 55A.053(a)(2)(A) after successful completion of a veterans treatment court program created under Chapter 124, Government Code, or former law; or
(2) under Article 55A.053(a)(2)(B) after successful completion of a mental health court program created under Chapter 125, Government Code, or former law.
(c) A court that grants a petition for expunction of a criminal record may order that any fee, or portion of a fee, required to be paid under Subsection (a) be returned to the petitioner.
(d) This section expires January 1, 2026.
(b) This section takes effect immediately if this Act receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this section takes effect on the effective date of this Act.
SECTION 9.____. (a) Notwithstanding Section 19, SB 1760, Acts of the 89th Legislature, Regular Session, 2025, Section 1023.0071, Estates Code, as added by Section 5, SB 1760, Acts of the 89th Legislature, Regular Session, 2025, takes effect January 1, 2026.
(b) This section takes effect immediately if this Act receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this section takes effect on the effective date of this Act.
SECTION 9.____. (a) Section 23.303, Government Code, as added by SB 293, Acts of the 89th Legislature, Regular Session, 2025, and effective September 1, 2025, is amended by amending Subsections (a) and (b) and adding Subsection (b-1) to read as follows:
(a) The business court, a district court, or a statutory county court shall, with respect to a motion for summary judgment:
(1) set the motion for a hearing by [hear] oral argument [on the motion] or by submission on a date [consider the motion without oral argument] not later than:
(A) the 60th [45th] day after the date [the response to] the motion was filed; or
(B) the 90th day after the date the motion was filed:
(i) if the court's docket requires a hearing on a date later than the 60th day after the date the motion was filed;
(ii) on a showing of good cause; or
(iii) if the movant consents; and
(2) file with the clerk of the court and provide to the parties a written ruling on the motion not later than the 90th day after the date the motion was heard [argued] or considered.
(b) The [If a motion for summary judgment is considered by a court described by Subsection (a) without oral argument, the] court shall record in the docket the date the motion was heard or considered [without argument].
(b-1) Subsections (a) and (b) do not apply to a motion for summary judgment that is withdrawn.
(b) Section 23.303, Government Code, as amended by this section, applies only to a motion for summary judgment filed on or after the effective date of this Act. A motion for summary judgment filed before the effective date of this Act is governed by the law in effect on the date the motion was filed, and that law is continued in effect for that purpose.
