Dear Heavenly Father, as you worked in Esther's life, I pray you will do a similar work for the men and women in this room. I pray they will have cooperative spirits serving shoulder to shoulder and side by side. I ask that you give them compassionate souls to care for those who cannot care for themselves––the young and old, and the feeble and the frail. I pray they will have courageous hearts so that they will make decisions based not upon political expediency, but will do that which is right in your eyes and that which is good for all Texans. They have come to this position for such a time as this. May they be leaders characterized by cooperation, compassion, and courage. May they lead Texas well. I ask this in Jesus' name. Amen.

SB 1136 - STATEMENT OF LEGISLATIVE INTENT

REPRESENTATIVE ISETT: Chairman Capelo, it is my understanding that this piece of legislation only deals––and I'm looking at Section 181.005, on page 6, Duty to the Commissioner. And I just want to make sure that we understand that this only deals with a certain narrow section of HIPA law or HIPA requirements dealing mostly with definitions. Is that your understanding?

REPRESENTATIVE CAPELO: That is correct.

ISETT: And the intent of the law is not to allow the commissioner––when the Texas law is more stringent with regard to medical privacy. The intent of the law is not to allow the commissioner to move the Texas standard down to the HIPA requirement, but rather, in times when the HIPA requirement is more stringent than Texas law, to move that law up and thus avoid a constitutional question. Is that your understanding?

CAPELO: That's correct.

ISETT: Thank you.
