SECTIONi__.iiArticle 102.005, Code of Criminal Procedure, is amended by amending Subsection (f) and adding Subsections (g) and (h) to read as follows:

(f)iiA defendant convicted of an offense in a county court, a county court at law, or a district court shall pay a fee of $25 [$20] for records management and preservation services performed by the county as required by Chapter 203, Local Government Code. The fee shall be collected and distributed by the clerk of the court to the county treasurer, or to an official who discharges the duties commonly delegated to the county treasurer, for deposit as follows:

(1)ii$22.50 to the county records management and preservation fund for records management and preservation, including automation, in various county offices; and

(2)ii$2.50 to the records management and preservation fund of the clerk of the court for records management and preservation services performed by the clerk of the court [in the same manner as fees are collected and distributed under Section 51.317(c), Government Code. The fee received by a county shall be placed in a special fund to be called the records management and preservation fund. The fee shall be used only for records management and preservation purposes in the county as required by Chapter 203, Local Government Code. No expenditures may be made from this fund without prior approval of the commissioners court].

(g)iiA fee deposited in accordance with Subsection (f) may be used only to provide funds for specific records management and preservation, including for automation purposes, on approval by the commissioners court of a budget as provided by Chapter 111, Local Government Code.

(h)iiAn expenditure from a records management and preservation fund must comply with Subchapter C, Chapter 262, Local Government Code.

SECTIONi__.iiSection 51.317(c), Government Code, is amended to read as follows:

Amend SB 1821 (House committee report) in SECTION 1 of the bill, by striking added Section 3818.007, Special District Local Laws Code (page 4, lines 6 through 20) and inserting the following:

Sec. 3818.007. CONTRACT WITH DISTRICT. The district and a municipality in whose extraterritorial jurisdiction the district is located may enter into development agreements under Subchapter G, Chapter 212, Local Government Code, concerning development of the property within the district and annexation of all or a portion of the district by the municipality.

Amendment No. 1 was adopted.

Amendment No. 1

Representative Uresti offered the following amendment to CSSBi1892:

Amend CSSB 1892 as follows:

(1)iiIn Section 1 of the bill, in added Section 3833.003(b), Special District Local Laws Code (page 2, line 8), strike "body's consent may be conditional, as" and substitute "body may condition its consent on any terms".

(2)iiIn Section 1 of the bill, in added Section 3833.021(b)(1), Special District Local Laws Code (page 5, line 5), strike "initial".

(3)iiIn Section 1 of the bill, in added Subchapter B, Chapter 3833, Special District Local Laws Code (page 8, between lines 13 and 14), insert a new Section 3833.0601 as follows:

Sec.i3833.0601.iiREPORTING REQUIREMENTS. (a) After each board meeting, and at least once per month, the board shall provide a written status report to each state senator and state representative who represents a portion of the district.

(b)iiThe report must include a copy of the board minutes, provide information on the progress of development in the district, and include information on district finances, obstacles to progress, successes, and all other important matters.

(c)iiThis section expires January 1, 2007.

(4)iiIn Section 1 of the bill, in added Section 3833.151(b)(12), Special District Local Laws Code (page 11, line 14), strike "City Public Service" and substitute "CPS Energy".

(5)iiIn Section 1 of the bill, in added Section 3833.151(c), Special District Local Laws Code (page 11, line 16), strike "(b)(4)-(12)" and substitute "(b)(4)-(11)".

(6)iiIn Section 1 of the bill, in added Subchapter H, Chapter 3833, Special District Local Laws Code (page 20, between lines 18 and 19), insert a new Section 3833.359 as follows:

Sec.i3833.359.iiPLEDGES. (a) The district may pledge to the payment of the principal or interest or any other amounts due under district bonds all or any part of:

(1)iidistrict taxes;

(2)iirevenue from a public improvement financed under this chapter, except as provided by Subsection (c); or

(3)iimoney from grants, donations, or other income or funds received or to be received from any public or private entity.

(b)iiThe district shall set and collect the pledged funds in amounts that are at least sufficient, with any other pledged resources, to provide for all payments of principal, interest, and any other amounts due or required in connection with the bonds and, to the extent required by the order or resolution authorizing the

issuance of the bonds, to provide for the payment of expenses in connection with the bonds and to pay operation, maintenance, and other expenses in connection with the public improvements undertaken by the district.

(c)iiThe district may not encumber, or pledge revenue under this section from, a public improvement that the district may be required to transfer under Section 3833.151.

(7)iiIn Section 1 of the bill, in added Chapter 3833, Special District Local Laws Code, between Subchapters H and I (page 20, line 19), strike "3833.359-3833.400 reserved for expansion" and substitute "3833.360-3833.400 reserved for expansion".

SECTION . Section 21.02, Tax Code, is amended by adding Subsection (d) to read as follows:

(d) A motor vehicle does not have taxable situs in a taxing unit under Subsection (a)(1) if, on January 1, the vehicle:

(1) has been located for less than 60 days at a place of business of a person who holds a wholesale motor vehicle auction general distinguishing number issued by the Texas Department of Transportation under Chapter 503, Transportation Code, for that place of business; and

(2) is offered for resale.

SECTION . Section 22.04, Tax Code, is amended by adding Subsection (d) to read as follows:

(d) This section does not apply to a motor vehicle that on January 1 is located at a place of business of a person who holds a wholesale motor vehicle auction general distinguishing number issued by the Texas Department of Transportation under Chapter 503, Transportation Code, for that place of business, and that:

(1) has not acquired taxable situs under Section 21.02(a)(1) in a taxing unit that participates in the appraisal district because the vehicle is described by Section 21.02(d);

(2) is offered for sale by a dealer who holds a dealer's general distinguishing number issued by the Texas Department of Transportation under Chapter 503, Transportation Code, and whose inventory of motor vehicles is subject to taxation in the manner provided by Sections 23.121 and 23.122; or

(3) is collateral possessed by a lienholder and offered for sale in foreclosure of a security interest.

Amendment No. 1 was adopted.
