Amendment No. 1

Representative Otto offered the following amendment to HBi1:

Overview

Appropriate $21,700,000 in General Obligation bond authority to the Texas Building and Procurement Commission for the Texas State Library and Archives Commission project of renovation and expansion of the Lorenzo de Zavala Building. The renovations and repair will replace the roof and elevators, replace the environmental controls and wiring and complete the abatement of asbestos. The expansion of archival storage space will accomodate the necessary archival growth for the next 20 years, according to the agency.

Increase General Revenue appropriation to the Texas Public Finance Authority for Bond Debt Service by $1,884,394 for the 2008-09 biennium. The increase would result in an $1,884,394 cost to the bill.

Required Action

1) On page I-14 of the bill pattern for the Building and Procurement Commission, increase General Obligation bond authority for Strategy B.2.1, Building Design and Construction $21,700,000 in fiscal year 2008 and provide for unexpended balances in fiscal year 2009.

2) On page I-16 of the bill pattern for the Building and Procurement Commission, amend the following rider:

The amounts shown below shall be expended only for the purposes shown and are not available for expenditure for other purposes. REASON FOR VOTE

The State of Texas entered this legislative session with a record surplus and an unprecedented opportunity to invest in our state and its people and to move Texas forward. Unfortunately, HB 1 fails to do this. Since 2003, the legislature has cut health care, shortchanged public education, and saddled middle-class Texans with higher taxes and hidden fee increases. In spite of these facts, HB 1 still does not even get us back to where we used to be.

Before the session started, Governor Perry ordered state agencies to limit their funding requests to 90 percent of their 2006-2007 budget. Anything above this artificially low "base" level was considered an exceptional item. As a result, many times in this budget what appear to be increases in funding are either just the maintaining of current services or a budget cut disguised as a budget increase. In addition, over $4.2 billion in available money is left unappropriated in this budget, money that could have been used to improve services.

For example, in public education, most of the growth in school spending would only cover the increased cost of enrollment growth in Texas. There is no increase in per-student spending. Funding for students with disabilities is cut. There is no new money for increased transportation funding to cover higher gas costs for school buses to operate. Schools are being given the same amount of money to assist children having trouble passing the TAKS test, but the schools will have to use the same amount of money to help children in three grades instead of two.

This bill is littered with decisions that highlight the misplaced priorities of this budget. The funding for the Children's Health Insurance Program provides funding for 100,000 fewer children than it did before 2003. Despite the emerging abuse scandal at the Texas Youth Commission, services have been cut and requests for additional officers and training were not funded. Money is drawn from a jobs training program to fund a program that allows Governor Perry to give out corporate subsidies. Money is appropriated to hire private lobbyists in Washington D.C., even though the state already has an office in D.C. to lobby for Texas. The budget raises the travel fund for the attorney general while providing less money for child support enforcement.

I consider this bill a missed opportunity. Texas could have used this surplus to improve public schools, lower the number of Texans without health insurance, significantly increase funding for higher education to make it more affordable, restore funding for our state parks, and increase funding for the state's transportation needs without toll roads. Instead, Governor Perry ordered state agencies to lower their funding requests, and if we gave them more than 90 percent of their budget from two years ago, we call it a funding increase. Because the house missed a wonderful opportunity to improve our state, I voted against HB 1.
